When do I need a notary?
If you want to buy property in Germany, enter into a marriage or partnership agreement or grant a power of attorney, such a legal transaction must be notarized by a notary public in order to be legally valid.
If, according to your own information or the notary’s assessment, you are not sufficiently proficient in the German language, an interpreter must be consulted pursuant to section 16 of the German Notarization Act. This is also the case if the document is recorded in a language other than German. This is also the case if the document is recorded in a language other than German.
How does a notary appointment with an interpreter work?
At the meeting, the notary reads out the document in sections in German, which the interpreter then also translates in sections, consecutively, into the foreign language for the client. At some points, the notary may add explanations for the client, which are of course also mediated by the interpreter.
After the notary has read out the document, they may ask the client questions, which the interpreter interprets. Once all questions are answered by the client, all parties (notary, client, interpreter) sign the transcript.
For a seamless experience at the notary’s office, it is advisable to hire sworn interpreters. In addition, you can provide the interpreter with the notarial deed or a draft of the deed before the appointment so that they can prepare a translation in advance. They can then read it out at the appointment accordingly. Depending on the order, we may contact the notary’s office ourselves and request the draft of the document to be notarized in order to translate it in advance.
If you need a certified translation of your document for submission to authorities or banks after the notarization in the notary’s office, the interpreter can subsequently certify the final version of the translation with a stamp and signature.
How much does a notary interpreter cost?
The cost of calling in an interpreter at the notary’s office may vary. Prices depend on the subject and scope of the purchase agreement or land charge. In this context, the German Judicial Remuneration and Compensation Act (JVEG) regulates the fees for interpreters and translations, unless otherwise agreed.
A high-quality interpretation at the notary requires a written translation of the sales contract or the land charge order. The translation is also important because you get a written translation of the contract in the foreign language for reference. This is particularly important if a legal dispute should arise at a later date.
On average, you can expect a half to full day’s charge for a notary appointment without a written and certified translation. Depending on the language and location, the costs regularly range from 450.00 Euro to 950.00 Euro incl. VAT.
What is included in the price?
- If explicitly agreed, a certified translation of the contract or the land charge order by a sworn and authorized translator is included in the price.
- Expenses for tickets, travel and parking. These can vary greatly depending on the language and location.
(regularly 50 to 150 euros). - Interpreting a contract in a notary’s office can be very time-consuming and extensive. As a rule, this cannot be done without preparation. Therefore, interpreters need preparation time to review the documents and, if necessary, pre-translate excerpts of the draft contract in preparation for the appointment at the notary’s office. Usually, the notary reads out the complex contract section by section, and the interpreter is required to transcribe what is read out, usually quickly, verbatim into the foreign language. Depending on the subject matter and complexity, this is only possible if the interpreter has previously translated the contract for themselves in excerpts in writing.
